On the face of it, without diving into the legalities, the main point against his serving as vice president is that the office is meant as the person who will step into the office of the president if the president in unable to serve in the office. If a president can only serve 2 terms then his serving in a role where he might become president seems unreasonable. A more interesting question, from my point of view is can he serve as an member of the cabinet? They are also in the line of presidential succession. If he were to serve as Secretary of State it would tricky. Though the office is 4th in the line it would take a catastrophic series of events to reach that point.

One final thing that I think hurt Romney, was what happened in Ohio and Pennsylvania, where Republicans went hard after voter rolls that tended to skew democrat. They tried to purge these rolls, making some minorities ineligible to vote. This angered and electrified the black vote in these areas, and they actually turned out for Obama in greater numbers than in 2008. Ohio was the key state. It broke for Obama, shocking Fox News, which wasn’t ready to announce him as the reelected president.
